What is the name of your state?Arizona

The G.M. of a private country club told the staff that if they did not get a properly signed ticket or a wrong membership number was entered, the employees would be responsible for paying the tab and would be deducted from their paycheck. All tips are on paper also and they are paid tips and wages in one check.

It is legal to make this deduction with out an employee previously signing a document that they are aware of this company policy??

I was with the understanding that an employee must sign a paper stating they are of aware of this type of policy and agrees to the policy before it can be legal to make the deduction.

There are two issues here that are a matter of your State's laws: (1) whether an employer can lawfully make any deductions without the employee's consent; and (2) whether an employer can hold an employee accountable for shortages, "quality defects," etc. In both instances and in the majority of States, an employer cannot.

I can't tell you what AZ reg's are on this so if you don't get a definitive answer here, call AZ's DOL and inquire. Could be the boss is just blowing smoke to make his point (which is stupid.)

According to my source, AZ law is silent on the issue of whether an employee can be held responsible for shortages, losses or breakages, but does forbid an employer from taking deductions that are not either required by law or expressly authorized in writing by the employee.

It is not illegal to threaten to do this, but the first time it actually happens, you can report him to the AZ DOL.
