Escrow refund/now wants reimbursement

What is the name of your state? Illinois
I refinanced over a year ago. Somehow something got confused with the taxes. My escrow refund was $3600 more than it should have been. I did not know there had been an error and thought the money was mine. Now, the old mortgage company sent a letter stating that I need to reimburse them the $3600 in 30 days or they will send me to collections. The escorw refund occurred more than a year ago. Since this was their error (although in my favor) am I liable for paying them back?

I love these kinds of questions.... as if an error by the other party was somehow a windfall......
And have to wonder if the circumstances were reversed (if you had overpaid THEM in error) and they refused, would you say, "Oh, okay. No problem!".
Of course you wouldn't..... and neither will they.
Pay them the money that you got to use!!

I appreciate your honesty but I have to ask, should I just blindly trust what they are saying? They sent no proof of this error, and when I called the number listed on the letter, the customer service rep had no idea what I was talking about. It's been more than year, is there a statute of limitations for how long after they can make this request? If I made such an error, I would expect that if I was calling them a year later they would at least want some kind of proof. Frankly I also expect that they would tell me I was SOL and should have realized this sooner. I might add that the supposed error with the taxes occurred 2 months prior to them sending me a check. Shouldn't a mortgage company have better accounting procedures?

**A: have you ever heard of sending a certified rrr letter requesting the back-up documentation?
