What is the name of your state? CA
Eskanos & Adler had an Abstract of Judgement for a Beneficial Loan for the amt for 4322.01 but was never enforced in 2003. I checked my records and as of today i've paid them 4535.00. I called to let them now they owe me! The rep stated and faxed me a billing statement and it shows me owing them 5601.39. - Which leaves a balance of 1094.19. According to their records my priniciple is paid off, plus their atty fees, Court Costs. However, I still owe the interest from my original loan, and the Judgement Interest. Please!! Help!! Does the Abstract of Judgement override their records? Will i receive my overpayment back? What do I do? Thanks!

Sorry, bad news

Sorry to be the bearer of bad news. Once a judgment is entered, the abstract just is a record of the judgment that places a lien on your property, creating a separate lien on anything you buy. The post judgment interest and collection costs accrue and attach to the original judgment. Once you pay it off in full, including the post judgment interest, court costs, etc., then you will be entitled to ask for a satisfaction of judgment and you can record that in the counties where the judgment was recorded to clear the abstract of the judgment.
