Calif. Roommate filed a temporary restraining order to get out of lease all based on lies. I had gotten out of lease based on doctor's orders prior to his filing. He had abused me and I ended up in hospital for 3 days. I had to follow it until the court date when my side was heard. We both got out of lease. However, we both moved out during this time. I had to stay 100 feet away from him while I was moving. He followed me around and took pics of my daughter and me moving. He would approach US and when a few feet away snap a pic of us. Then he would call sheriff on ME citing pics as evidence.. The sheriff would come and cite me. The guy made a game of it. So I stayed away on the days he said he would move. I had not found a place to live yet. Now, we both owned cats. He begged me to take care etc of his cat and of course I did. On the last day of moving, it was his day to be there and I asked him to keep my cat safe in house. He didn't. My cat had never been outside. It is in the 30's at night outside and in. He is a short haired siamese worth $800. My ex roommate says he has no idea if he is outside or in but the house is empty and he is leaving town, tough luck. The cleaning people, which I am paying for, are coming at 8 AM tomorrow to clean. I can't get back to house till tomorrow since I work at night. I also cannot call, text or talk to my ex roommate due to the court order. I am all so the one who paid deposit an first/last months rent which he refuses to share. So I am losing money.
I am heartbroken and am afraid of what I will find when I get back. We lived in the wilderness. If my cat turns out to be hurt or sick or dead do I have a lawsuit against him?
