My ex isn't complying with our settlement. He is holding the final documents basically hostage, he agreed to all terms, now when it's time for them to be filed in court he won't sign. What can I do? His attorney's office is of no help. We have been divorced just over one year now.

I'm confused. If you're already divorced, what settlement document is he "holding hostage"? If the divorce decree/order states he is suppose to be filling out documents transferring ownership of assets or something similar, you need merely bring a motion for enforcement. However, if the settlement you're referring to is the settlement of all property rights and your divorce isn't final yet, then you may have to file whatever documents your local family law courthouse requires to set a trial. Its hard to answer accurately on the web because I can't see the documents you're referring to and I don't know in which state these proceedings take place. I recommend you consult with (not necessarily hire) a local family law attorney to get an accurate answer. Bring in ALL the legal documents filed in your divorce thus far and a copy of the settlement your ex is dragging his feet on. Once a local attorney has reviewed all the documents, he/she will know at what stage the legal proceedings have stalled and that attorney should be able to advice you on your next move. Besides, it can't hurt to have a local attorney review this settlement document to make sure you're getting everything you think you're getting. You may find out you don't want this document filed at all! Best of luck to you.

If your ex refuses to sign or is withholding the documents a Judge can over ride him and sign for him, and have everything filed, at your X's expense. They can also find him in contempt if he doesn't comply.Talk to an atty as CDCARD has said.
