What is the name of your state? nj If there is a child support order in effect for the non-custodial parent and the custodial parent has lost custody of the minor child to the grandparents due to a dwi and drug abuse... what happens to the support order. The non-custodial parent owes arrears and his paycheck was just garnished, (he wanted it garnished for child support) and his ex (custodial parent) is still getting child support checks, but shouln't that money be going to the grandparents who have custody. We know his child won't see any of the support if the ex gets it, she'll just spend it on partyin' and drugs. We just want to see the support go to the child. What are his options in new jersey? The child support officer on his case is no help. Any advice will be appreciated!!!!

If the grandparents officially have custody, then they need to go down to the CS agency and explain the problem to them. They can probably get the support re-directed to them instead of the mother. They just need to be very careful not to open a second case....they need to explain it clearly.
