Ex wants to give up parental rights?

What is the name of your state (only U.S. law)? California

My ex husband wants to give up his parental rights so he wont ahve to pay child support. He says he "I dont think I should have to pay you to raise the kids when I dont see them anyways". I have full Custody and have remarried and live in another state due to my now husband is in the Army.
He calls the children once a month if not once every other month. We have been in another state since last June and the children have not asked about him or have wanted to talk to him for about 6 months since he stoped calling. He paid one full month of child support last year with 3 months of 200 a month and for 3 children he pays 800 a month. I filed contempt charges in Dec, after all year of not getting much of anything to help support our children and then he wanted to make an agreement between us to get him out of it, we did and I made it flawless, he couldnt get out of it even if he had a great lawyer, once the contempt charges were dropped in the end March after him paying for Jan, Feb and Mar. Now he doesnt want to pay again and wants to just give up rights and have my husband(we got married in Mar this year) adopt them, but we dont want to do that yet.
What is the best way to go about this for California or what papers can we file or is it worth it? I want him off their birth certificate since he doesnt want to help support them and feels that he doesnt have to since I am raising them. But if he signs them over he wants to visit and have contact with them still. And if he signs them over I want him out of their life for good.

so the big question is....does your future husband WANT to adopt? does he realize that by doing so, in the event you and he get a divorce, he will be set for chid support for ALL children?

If your husband does not wish to adopt your children then Dad will not be let off the hook.

Did you have either DAD'S permission or a JUDGES permission to take the children out of state? Have YOU followed the LDPP?

So since you took the children out of state, what have YOU done to facilitate their relationship with dad? Have you told them to call him once a week? Have you worked out a long distance visitation schedule that YOU pay for transportation since you are the one who moved? Do to remind your children to send dad emails so he knows how they are doing? Or have you been content to let them forget about their dad?

Many fathers think that by ignoring their kids they can ignore their child support obligations.
Think how many kids would be fatherless if a man can just walk in and say "I don't want to be a father anymore. I'm going to give up my parental rights"
It's doesn't happen that way.
If your new husband doesn't want to adopt the children, your ex-husband can't do a darn thing about it! Period!
