I worked for a company based out of Atlanta, GA The company has some major financial problems and my pay was getting to me later and later. On May 20th, the day before my vacation I still had not received the check that was promised to be there by then. I called the office and one of the owners got so mad that he fired me. The other owner called back acting as if it were a "joke" and said he was calling to rehire me. I was furious and refused. He told me to take my vacation, and he'd leave everything as it was prior to the phone call. The check came the next day and the following check was overnighted the day before I returned from my vacation. I decided to NOT return to this job. They paid for all of my office expenses, phone, postage, dsl, etc. When I went to change the phone and dsl account back to my mailing address, I found out the bill hadn't been paid for March, April and May. I also never received my pay for the week I was on vacation. They said I had quit on the 20th of May. Here's my question.....They owe me over $1600 in pay and expenses incurred due to my employment. I have a check that was issued to me dated 5/4/04 in the amount of $1200. The check was replaced as it was mailed late by them and I insisted they overnight another one. Can I legally deposit this check? Thanks for the help!

So is the 5/4 check the replacement check or the original one that showed up late? If the latter, I expect a "stop payment" was issued on the check. If it's the replacement check, I don't understand why you are asking if you can "legally" deposit it. Why not?

They owe you money - this is part of it.
