Facebook Pictures

What is the name of your state (only U.S. law)? Maryland

I know to many this question may seem very petty. However, in my area, online predators are a huge problem.

Some of you may be familiar with part of my story. My ex and I have not been together since 2006. He does not have any form of custody, and does not wish for any form of custody. He prefers to come and go as he pleases. He has only seen the children a few times since 2006. I have never denied him the right to see my children, but he has not shown much interest. I have had issues with him posting pictures of the kids on his facebook, and he has since made his facebook page private, so pictures he posts are not an issue.

Recently, he decided that three weekends in a row, he would see the kids on Sundays for 5 hours, which he said was going to be a permanent thing. Of course this was not, and I did not hold my breath. During these visits, he took my children to see his new girlfriend, which I did not have a problem with. It is not my business to say who he has our kids around, as long as the person does not pose any harm or threat to them. From what I understand, she is a very sweet girl.

My problem is with the fact that she has pictures of the kids on her facebook page after meeting them only twice, which to say the least is a little weird. Especially since she is marking them as her children. Her facebook page is open for all the world to see, and there are no privacy settings. She apparently does not know the dangers that lurk online, because she also has her physical address posted on her facebook page as well.

A few mutual friends pointed this out to me tonight and when I looked, I was amazed to see about 10 pictures of my kids. Do I have the legal right to ask her to take the pictures down or to make her facebook page private?

Do I have the legal right to have these pictures removed or ask her to change her facebook status to private so that my children are not exposed to the world? Especially since their father has no legal rights to them?

You have the legal right to ask her to remove the pictures. And she has the legal right to refuse.

I'm sorry - I know this isn't what you want to hear, but unfortunately for you that's the reality.

You COULD always flag the pictures and report them to FB.

And from a personal opinion point of view? Yes, I agree that's just a tad weird. She's met her boyfriend's kids twice and she's putting up pictures and labeling the children as hers? Yeah. That's a little OTT.

Thank you very much for your quick reply. I reported the pictures to Facebook. Hopefully she will take them down. All in all, I would be happy if she set her profile to private so the whole world wouldn't see pictures of my kids.

I completely understand where you're coming from.

I absolutely do.

Here's the other side of it though - all Dad has to do is put the pics on HIS site, and tag HER in the photos. That's how many people get around it.
