Purchased and closed on newly constructed home 12/03, presented to us as "Paradise X" subdivision, Phase 1. Open house, real estate brochures & literature, appraisal, Bill of Sale, everything advertised and represented this home as Paradise X, Phase 1.
However, my deed says something else, another subdivision name, north of my actual subdivision. I phoned the attorney in Arkansas, who did a video closing which is common with the real estate agent who listed the home for the builder...and the attorney advised me that this was a problem he too encountered also when closing on the homes in Phase 1, this one street of homes (Phase 2 is currently under construction and almost completed). Attorney states that evidently the builder and real estate agent were advertising this entire street of homes as Paradise X, Phase 1, prior to approval by this county's Board of Supervisors. ??? Huh?
My appraisal on the home list it as Paradise X. Not the deed. All communicative literature and brochures, to include real estate guides list it as part of Paradise X. It is not. And it will never be. My actual deed reads something entirely different. The deed reads "X Park," which is the name of a subdivision a few streets over of less expensive homes. I questioned the realtor about this and they acted clueless. However, they had an open house in my very home, passing out literature saying it was Paradise X, complete with a huge sign in what is now MY front yard...upon moving in, the sign was moved back to Phase 2, but still is painted Phase 1. Same sign.
This home was advertised as one thing, everything says that it is...but the DEED.
Also, we had a one (1) year warranty on the home. The Builder has failed, despite repeated verbal and written (certified mail-return receipt requested) requests to perform all the needed warranty. Mainly, the front door and side lites (filled with some type gas?) are defective and the seals are pulled apart inside the close, unsightly! The Builder procrastinated and the warranty on the door expired, then, now, supposedly the glass inserts are no longer available. We have been advised they would replace only the center portion, the main door, and perhaps plywood the side lites, that will no longer have glass at all?
Unbelievable. I say we want what we purchased. A door and side lites, the complete unit.
Regretfully, I did file a formal, written complaint with the MS Board of Contractors a few days ago, to date no response. Any advice or suggestions would be most appreciated.
