What is the name of your state (only U.S. law)? California
I was detained by Kohls Security, forced to sign a document that stated I was never again allowed at anyKohls, or parking lot, videoed and Identified as a shoplifter by the security there without ever talking to manager of store, police, or lawyer. I never set foot out of the store with un paid merchandise. I 2 days prior paid my (4 year gold card member) card payment of $300. tried to by some merchandise was told that transaction had to wait til payment cleard in 2 days, they took my name, number, card number, and merchandise, to be held at cus. ser. for 2days then come back to complete transaction. Came back went to where cashier told me. confirmed events and purchase with cus. ser. was given back baged merchandise, after cus.ser. confirmed my payment, asked if I needed to go to register was told no.Before I left store I was grabbed in a very abusive and embarrassing way by security. I was eventually released when the police officier arrived, viewed video, and told me that I was in right, but it would be up to Kohls security if they persued this with DA.. This charge could not only cause me embarrassment, loss oftime at work, but put my position at my employment in serious jeopardy, as well as get my TWIC card needed for my propfession revoked, I did nothing wrong ...and the extent of rudeness by security as well guilty before proven, isn't this against my rights?? or am I in jeopardy what do I do?

It is not against the law for store personnel to detain a possible thief. If you feel they had no legal grounds to detain you, and that you have been damaged by the detention, you can seek damages and even sue them if they fail to pay up. However, just how much in ACTUAL damages have you suffered?

If you feel you have a case, consult an attorney who can give you a better feel for events.
