False claim of guardianship?

What is the name of your state? Colorado

My mother is currently hospitalized and is about to go into long-term acute care due to a forefoot amputation from untreated diabetes. Three years ago we attempted to get her to go into assisted living (largely because we were concerned aout her health.) She became angry with us and stopped speaking to us for several years. Recently, she has relented a bit (since her hospitalization, she is welcoming us back into her life, at least mostly.) As her only child, I feel responsible for her wellbeing and care. She is deemed competent by mental health professionals. However, it has come to my attention that someone in her neighborhood is claiming to be her "legal guardian" and has made this claim to a number of people. I cannot find any information on line about this; my mother denies that it is true, but I am afraid that she was coerced into signing something. If it is true and she is competent, we can fight back. If it isn't true and this guy and his wife are making false claims, what can we do to stop them? Isn't this illegal? Thank you for any help you can give. -- Linda

If a guardian has been appointed, there is a guardianship file in the probate division in the courthouse. You can first check on line by entering your mother's name in the public records of the courthouse. All you will be able to view is that there is indeed a guardianship. Should you not find anything, a trip to the courthouse is in order as not all records on available on line.

If you do not find anything, there is no guardian. Either the neighbor is lying or had your mother sign a Power of Attorney, which can be revoked by your mother.
