New Jersey. My ex tried to negotiate extra visitation time for the 4th of July holiday. I declined and asked that he stick to the schedule. at 8:00 pm when he was supposed to bring the kids home I asked my sister to call him and ask what was his time frame for returning the children-- he said 'tomorrow at 8:00pm'. This was not what we had agreed upon and this was clearly stated in letters between myself and his attorney (I don't have an attorney). A few days later when I spoke to him about this he said his attorney said to go ahead and do it. My sister says I should have pushed every legal button avilable as this was wrong. Does anyone know what I should do and what exactly is the "crime"? ?Interference with custody? Contempt? What about the attorney?

My response:

It's called getting him back to court on an "Order to Show Cause Re: Contempt of Court for Interference with Custody."

However, this instance is over. Because you can't prove that he did this to you, a judge won't even entertain the the OSC because your ex will deny the allegations.

The next time this happens, go to the Police, and have them help you to get your child. Bring your court orders with you ! Then, a report of the incident will be made, and then you'll have the proof you need.
