Father wants custody/vistion after signing off rights!!!!!!

Ok when my son's father was 16, I was 20.He signed off his rights and wasn't forced but we agreed to do it in the best interest of our son. (My parents have cutody)He's not been really involved in our son's life, except when it was convient. Now our son is almost four and he decided he wants custody or visition rights. He hasn't held a job for more then 6mths at a time. Doesn't really live anywhere, lived in his apt. but now staying w/his uncle,or g-friend.
I want to know if he can get either. My son's father is a true deadbeat dad. PLEASE help,we live in Indiana. Thank you.

I'm an attorney in Indiana and will try to answer your questions.

Are you saying that he agreed to a termination of his parental rights? And was that agreement approved by the court?

And your son was adopted by your parents -- or do they just have physical custody of him?

If he has NOT terminated his parental rights and has not supported the boy or seen him on a regular basis, then his chances of getting custody are slim and none. If under those circumstances he merely wants to visit, then his chances are higher.

If he HAS terminatd his parental rights, then he has no child support obligations NOR visitation rights, unless the child's legal guardians/other parent agrees, depending on who has what rights.

If you could answer my questions above, I'd have a clearer picture of your situation and could probably give you a better answer.

termination of rights.....

Im not sure where live but when i was 20 I had my son, I was married and when we got divorced he terminated his rights, He hasno obligations what so ever and never attempted to see my son even when he had rights.. about one in a half years ago the father decides he's going to try and get his rights back, not that he really wanted them back but to just do it to make me mad... Well the judge told me that he will not be able to do that because he terminated his rights, he is not able to see my son until he's 21, and if my son wants to see him... So no matter what he tells you.. From What I've been told by Judges is that NO he can not have or get his rights back once he terminates, unless you agree to it... My son also has had his middle and last name changed to my last name... so I wouldn't worry.. but thats me:) Hailey
