father wants to undo relinquishing rights

My husband signed off after paying child support and back support while waiting for blood test to return. He is the father and did sign off. Does he have a chance to undo this or not? How do we go about doing this if we can? Paying support again is not a problem. He regrets it, but he also never got to see the child the whole time he payed support and the mother and boyfriend told him if he didn't sign off they would take him back to court. At the time he was singal and now married and regrets it. Any advice would be appreciated. Also, if he doesn't have rights or can't reverse this does my daughter have any right to see her half brother?

Has someone adopted this child as a result of the Father relinguishing his rights? Does this child have a "legal" Father right now?

that is the problem

He was supposed to have adopted him after my husband signed off, but we have no idea if he did or not how can we find out?

If the child has indeed been adopted, then in order for your husband to retrieve his parental rights again the adoptive Father would have to relinguish his. Process starts all over again. In other words, your husband is no longer the legal Father to this child if the child has been adopted. Adoptions are final, and cannot be reversed because of a change of heart. If you do not know if the child has been legally adopted, try contacting the court house where this all happend and ask for the records. Your husgand HAD to of signed papers and been served, if the adoption was going to happen it would have been in the paperwork.

As far as the half sibling, contact the parents and see if anything can be worked out to pursue contact with the children. If they disagree I'm not sure there is much you can do. The legal rights to this child have been severed by your husband. The Mother and adoptive Father have all the say in this childs life.

What kind of papers should he have been served pertaining to the adoption of the mother's boyfriend?

Normally, when someone religuishes their parental rights there has to be someone there to adopt the child and accept full responsibilty for them. That is why it is VERY hard to relinguish your rights as a parent when there is no one to adopt. So most likely (depending upon how long ago this was) his parental rights were willingly terminated in order for the adoption to take place. Your husband HAD to of signed papers stating the intentions of the termination of his rights...Did he keep the copies of what he signed?

I believe he did keep the papers i believe they are down stairs in a box marked important papers. What if he was supposed to adopt the child and never did does my husband have any rights then?

Find the papers and look through them. If the child was never legally adopted I think that your husband could possibly fight to re-establish his parental rights..I suppose it would be like adopting him. (even tho he is the bio Father) I'm sure it would take time and alot of money. Find the papers, if there is nothing pertaining to an adoption then seek out to find out if the child was legally adopted. Contact the court house. Then go from there.
