felony restriction on eit test

What is the name of your state (only U.S. law)? ca

I was released from prison on june 28, 2008. Since then i have been going to school for civil engineering. I am getting ready to transfer to a state college and the dean said u cannot take the eit test if you have a criminal record. is there any way i can petition this. I feel this is unfair and unconstitutional. I've been getting my life together for the past two years i dont see how they can use my criminal record against me for a field that doesnt have anything to do with my charge. I was convicted of cultivation of marijuana. If this is not the right subject area could someone direct me to the right area of law.

Such acts or crimes include, but are not limited to, any act which, if done by a licensee, would be grounds for disciplinary action against that licensee by the Board; a violation of any provision of the Professional Engineers Act; or conviction of a crime (felony or misdemeanor) that is substantially related to the qualifications, functions, and duties of a professional engineer if, to a substantial degree, it evidences present or potential unfitness of a professional engineer to perform the functions authorized by his or her license in a manner consistent with the public health, safety or welfare.
THIS IS WHAT IT SAYS IN THE EIT TEST THING. so would cultivation of marijuana be grounds for this.

Why would you believe the dean would not know the requirements of the license?

The dean may not know the requirements.

The poster should contact the organization which administers the licensing directly for a written ruling before abandoning his career

Somehow, I suspect the powers that be would not be too keen to have someone who's known to have grown weed (and the logical assumption there is that same person partook of his own product) designing/building bridges and other infrastructure.

so if i get my felony expunged would that solve all of my problems. if so, how long do i have to wait for that, it has been for years since my convivtion nd 2 years since i was released.

What specific offense were you convicted of (code section)? And are you still on probation or parole?

So you actually contacted the licensing authority and asked for a ruling on if your case is disqualifying?
