I put a $7,000 fence up around my old house in Oct 1997. I sold this house 30 Mar 00. Now 8 months after sale the following has come up. The fence I put up was 3" on one side and 24" on the other on the neighbors property. I had the fence co. put it up along the clearly defined property markers. The property was not resurveyed prior to sale. I sold the house. The neighbor now surveyed the property and discovered the problem. He blames the fence co, saying they didn't want to cut tree branches so they moved the markers. The new owner blames the original survey, however has since contacted me and told me if I don't move HIS fence he will sue me. The cost of moving the fence is $677. I offered $200 in good faith to avoid a law suit. He wants it all or he sues. I am still liable after the sale of the property? All parties involved admit there was no INTENTION of putting the fence on the wrong property, everyone blames everyone else. Am I still LIABLE? I live in Williamsport, Pennsylvania (North Central PA). The attorney I contacted has said it's a "grey area" if it goes to court it will just depend on the the whim of the judge that day. Do I pay it, do I go to court and fight it? Isn't it "buyer beware"? Not seller beware? Any help, any suggestions would be appreciated. Thanks a lot.
