What is the name of your state (only U.S. law)? California
I purchased my home in July of 2008 at 6.75% locked FHA loan. I was contacted by a lender that offered a FHA Streamline refinance with no appraisal or credit check.
I received the first round of documents I need to sign and I had a couple questions.
1. On the Uniform Residential Loan Application and Good Faith Estimate the new rate is specified at 5.25%. However, on the Federal Truth-in-Lending Disclosure, the rate is listed at 5.816%. Why would there be a discrepancy? I am assuming the higher rate represents something the lender tacks on?
2. The Interest Rate Lock-In Agreement is blank (Only a box checked showing My guaranteed locked rate is 5.25%) with no amounts listed in Origination Points, Discount Points or Commitment Fee. Which form is correct regarding my interest rate? And wouldn't there be a risk signing a document that has blank areas that could be filled in later?
3. I purchased the house for $287,000. The payoff amount is approximately $280,580. The new loan is financing for $287,509, why would that be so much higher than the original payoff amount?
I do have a call into the lender to ask these questions. However, with the rampant fraud in the lending industry right now, I want to make sure I am not overlooking a serious sign of trouble.
