State Judgment is filed in? CO.
I promise this is it! The last one that I have to deal with before I am out from under this.
Quick background... Business closed in 2003 and left with tons of debt, I felt I could manage to get them all paid off in a 2 year time period. I knew it would not be easy but I did not feel right about filing bankruptcy although hind sight is 20/20. Anyway, have cleared up and paid almost all of it with the exception of my other posting and this one and 2 other companies that will be paid off by end of the month. This company was the equipment lease. Original lease was for 20,000 and company sold or switched names in my 20th month of lease. I paid on time for 2 years with no problems (it was a 5 year lease). At the end when I knew business could no longer survive, I contacted company and told them what was going on and how would they like to handle it. I agreed to pay and have the equipment boxed and ready for a pick up by the company that they provided. All went well and they were suppose to contact me with remaining balance after equip was sold and applied to my account. In the mean time, I was not aware that they were going through transfers back and forth between renaming their company and selling off papers of certain divisions. Fast forward to future, received call in March of this year (first time) about it and was told to pay 29,000 to the lawyer calling. He said lots of paperwork had been lost (affadavit attached to judgment to confirm that) but that he had the 3 pages he needed to sue me for all of it. He knew I had paid for 2 years and that the equipment was returned but they had no records and said it was up to me to provide the proof. I don't have that proof (yet anyway, trying to work on it) and they filed judgment in April for 31,000 in Denver and got it as I could not be there. Reviewing the paperwork, they even sued me for repossesion charges which they claim they did not even have nor is it attached. Do I have any recourse to get this reheard by the judge? And how can I do it as I don't have the money to fly back and forth to Denver? Sorry so long but would appreciate any insight of my next step.
