Fighting Possible Contempt Charge
What is the name of your state? NC/FL My boyfriend has a very high payment of $600 for one child born out of wedlock. The child support order was originated in FL but my boyfriend now lives in NC and he has received documents through the agency here. He has been unable to pay child support over the past 3 years due to a decline in his area of work. He has tried to find suitable employment but has only been able to find other jobs that haven't really paid enough for him to make his CS payments. He went to court to try and have the CS payment reduced but because he owes about 3 years of back payments the attorney says he may try to hit him with a contempt charge because he has only been able to make 2-3 payments over the last 3 years. There really is no excuse why he couldn't have tried to make more payments over the years other than the fact that his job does not guarantee a steady paycheck each month and he often would fall behind on his bills.
To fight the contempt charge we are hoping to amass some funds to pay down the arrears. Unfortunately, since the 3 jobs he currently has do not pay enough to pay his bills and the CS payments I would have to help him come up with the funds. Being that I'm already paying most of his bills and my own we are trying to figure out exactly how much money we need to scrounge up to pay down the arrears before his next court date.
I'm hoping to get answers on the amount that will keep him out of jail as well as what else can be done to possibly get the CS payments reduced or temporarily placed on hold while he gets back on his feet. Thanks.

If you are not a lawyer with some valid advice please do not post to this thread. This is a serious matter and obviously no one has the right to pass down judgements on others especially when you don't know all the details. Thanks for your cooperation.

Now, let me give you a bit of advice. It's personal advice, from someone who's BTDTGTTS.

Don't you let this man get you pregnant. Don't marry this man and have children with him. If he's not man enough to work odd jobs, deliver pizzas, deliver newspapers, whatever it takes to support the children he's already got and himself, then why the heck would you play house with him?

$600 is not very high. You want very high, my ex used to have to pay me over $1000 for 1 child. Now THAT'S very high. He's just under $1000 now. Still very high.

The contempt has already happened dear. Now, you can help him pay down the arrears and maybe he won't have to spend as much time in jail though.

If you choose to do that, that's your business, but you're not going to get any sympathy here.

The total amount of the arrears is just about what it'll take for there to be no finding of contempt.

He should go to court and ask the judge to tell the child to put eating on hold until his "father" gets back on his feet. If the poor kid can do that, then they will suspend his CS payments. If not, then perhaps he should spend less time wining, dining and probably bedding his new flavor of the month and pick up yet another job. See, if he has time to get and keep a girlfriend, then he's not using his time wisely at all.

CourtClerk took time to answer your post. And brought up valid points.

And you deleted it when you didn't like what you were hearing.

Realize that if your bf cannot support his prior child then he cannot support YOUR child so don't get pregnant with him. NO one was nasty to you. You were rude by deleting your thread however.

Question Change of Jurisdiction
I currently reside in the state of North Carolina, however my child support order is through the state of Florida. I am currently behind in child support payments and have been issued a hearing date in Florida, is there anyway to transfer my case to North Carolina? I was told that I might be able to file a motion to change jurisdiction, is that correct? If so, do you know of any websites to help you create one? Or is that something that has to be filed by an attorney?

Wonder if this is our deleting friend? :rolleyes:
