File or not to File?????

What is the name of your state?FL

Because of an unfortunate incident, I have a mountain of old charged off debt (about $40,000), the creditors have charged them off and they have not bothered me for the past three years - I have no way of paying them even if they did - with that said.

Should I file for ch 7 before new law to protect any future collections or should I just leave the old charged off debt on my credit report. What is best for future to build new credit?

For that amount of money, I'd file. I'd be wiling to bet someone will eventually sue.
