I recently resigned my postion with my employer. According to my hire agreement I am entitled to an annual bonus. According to state rules, I am owed this bonus proportinate to the length of employment as long as the relationship was due to mutual concent between employee and employer or if temination was initiated by the employer through no fault of the employee. My previous employer has denied my claim saying my resignation and thier subsequent acceptance of my resignation does not fall under the legal definition of Mutual Consent. However, they cannot, or will not provide me with a legal definition of Mutual consent. Can anyone provide me with a legal definition of mutual consent and advise me as how to procede.
