What is the name of your state? Minnesota

What is the law regarding final paychecks. I gave 4 weeks notice, my last day is on January 5, what is the legal amount of time they have to get my final check and vacation pay to me?

Also, is there a law as to how long they have to get my 401k money to me too.

Final Pay: If employee quits: next payday. If payday is less than five days after last day of work, employer may pay on the following payday or 20 days after last day of work, whichever is earlier. (Minn. Stat. §§ 181.13 and 181.14.)

Vacation: Pay may or may not be owed. Company policy can determine when any benefits are due such as vacation, sick leave and severance packages.

As for your 401: You will have to review your benefits plan.

I can only comment on your 401k plan

We just went thru this not to long ago. You have to innitiate for the disbursement of funds in that account. I would suggest rolling it over to a new plan but thats another forum.

You ex employer will notify the rep for the company plan that you were terminated or quit. All this will do is stop payments coming from them. You contact the plan rep and discuss with them what you want to do with the money i your account. You can withdraw it and pay penalties or roll it into another account thru your bank or new job.
