What is the name of your state? IL, but employer office located in Virginia.

I have lawfully left my previous employer after completion of my six month and giving 2 week advance notice, as mentioned in employment offer letter. I have received my part of final settlement, but also in offer letter it was mentioned that I am suppose to receive $5000/- after completion of six month of service and I have not received the same as a part of my final settlement.

I have sent atleast 8 - 10 emails to HR and called up atleast 15-20 times. They are not denying it, but they are also not paying it. It is almost more than 2 months now and appears that they are not willing to pay for it.

Also they have not given me experience letter which I am suppose to receive.

What are my options ? Should I wait another 3 - 4 months for them to turn on that $5000/- and experience letter ?

Any advise appreciated.

It is not impossible, but it is rare that an employment offer letter constitutes a contract. Whether or not they can be compelled to pay you the $5000 is going to depend upon whether or not YOUR offer letter reaches that level. You will need to show it to a local attorney for that determination.

Only a very few states require experience letters under the law, and neither Illinois nor Virginia is among them. What's more, even in the states which DO require experience letters, it is incumbent upon the employee to request it IN WRITING. The employer is NOT required to automatically provide them.

Exactly what kind of "settlement" are you talking about? That could refer to a bonus payment, a judgement ordered by a court, wages due you, etc.

Please define what you're referring to. You need to clearly state what monies you are owed and for what.

The settlement is part of my package which has been defined in my offer letter. Out of total package of lets say $60,000 company agreed to provide $5000/- after 6 month completion in addition to my bi-weekly wages.

Hope this clears the word "settlement".

RVJ, I suspect English is a second language for you and consequently we're going to have a bit of difficulty getting at all the pertinent issues here. (However I assure you that you speak English far better than I ever could your native tongue, whatever that may be.)

I going to guess that you had an employment contract with this company since you refer to a six-month agreement. You need to see an attorney. A letter from an attorney threatening to sue for what you are due will hopefully be all that's required for them to pay up.
