I have been fined by my strata condo council for failing to stop at the carpark gate an wait until it closes. I wrote in to appeal - at least give me a warning first - before simply sending a $200 fine. I also cited Strata Act 135 -
(1) The strata corporation must not
(a) impose a fine against a person,
for a contravention of a bylaw or rule unless the strata corporation has
(d) received a complaint about the contravention,
(e) given the owner or tenant the particulars of the complaint, in writing, and a reasonable opportunity to answer the complaint, including a hearing if requested by the owner or tenant, and

To me the above sounds like, they should write a letter to warn me first. But the first letter I rec'd was a fine already.
They declined my appeal also - saying that signs posted on the gate were warnng enough. However - that does not comply with "in writing" does it?

I think we are supposed to answer questions about US law only.

Strata councils are only in BC, are they not?
