What is the name of your state (only U.S. law)? Nevada
I don't know if this is the right forum section for this question. The issue is with a firearm I purchased from Lancaster Arms LLC in Goodyear, Arizona. I purchased the rifle in September 2009 via Atlantic Firearms LLC, a dealer that had a contract with Lancaster Arms. It was sold with a lifetime warranty via Lancaster Arms.
The issue is the rifle fell apart the first time I used it, essentially it self destructed. The rifle was over gassed due to being manufactured incorrectly, this is the reason given by Lancaster Arms. It was sent in at their request for repair in October 2009 and returned in November 2009, "repaired." I didn't test the rifle as I should have when I received it, and only fire it occasionally. In January 2011, the same problem occurred. Again at Lancaster's request I returned it.
By that time Lancaster had posted on their website a list of serial numbers, for rifles that were manufactured incorrectly and were recalled. Mine was included. The reason given was the over gassed system due to a manufacturing error on one of the parts. They stated on their website that the turn around time would be between 60-90 days.
I don't want to post every interaction with them, as it's a very long list, but they held the rifle until June 20th, 2011. During the time in between, my emails went unanswered and my calls were mostly ignored. When I could get through, I was promised multiple ship dates which never occurred. Finally, I got into contact with the local police department and was told to send a certified letter of demand for the return of my rifle. On the 21st of June, I called and was told by the owner that my rifle was shipped two months ago to another address, but that he would replace it and would call me back as soon as he found more information. I then checked a tracking number which I was sent about two months ago and saw that the rifle had shipped and was due to be delivered that day. I called and notified them and gave them the tracking number, since apparently they didn't have it any longer.
I noticed the rifle had a different serial number than the one I sent in and was a lesser model than what I had purchased. I faxed them and received a response asking me to return the rifle to have the issues I brought up addressed. The problem is I don't know if this company will last too much longer and I am afraid I may loose my rifle if I return it. I was told it would take about one month to conduct the repairs, but can I ask them for some type of guarantee in writing? Would that ensure me anything? If not, do I have any options? What is the name of your state (only U.S. law)?
