My 45 year old uncle had been with his company for over 15 years. He was hurt and nothing was ever done. He finally consulted an attorney and the attorney took his case. However, he has since returned to work and when the company found that he had an attorney, they fired him. We live in California, Tulare County. Who can we contact about this? Is is Labor commisioner, Dept. of Labor.., who? and what Dept.?
Please help. He has 5 children, one of which in currently attending Fresno State. he cannot afford to be out of work and without compensation.

if he was hurt at work and is fired for making a workers' comp claim, he has been illegally retaliated against.

the claim can be made for both retaliation and for disability discrimination. you should contact a few employment lawyers for to discuss how to handle the case. call the local bar association to find a few employment lawyers. they'll usually talk to you free for an initial consultation. see what they say and who you trust.

the california labor commissioner can prosecute actions for wages lost from an illegal firing, but your own lawyer may do better. however, here's a listing of the labor commissioner's offices: http://www.dir.ca.gov/DLSE/offices.html
