Fired because someone else was stealing money

I am looking for representation in a employer related issue. I was fired for, "not protecting the companies assets", however during the termination conversation I was told that my boss did not believe it was me that took a large amount of money from the company. He believed it was my assistant as I was the store manager. I would do morning paperwork by doing data entry and then counting up the cash earned by the store from the previous day. I would then fill out a deposit slip, put it and the money into the bank bag and then place it all into the safe. I rarely went to the bank, my assistant almost always went. I believe this amount to be over $10,000.00 ​that the company has tracked as missing. When he told me this, I didn't believe it. I recounted the figures that the cashiers turned in for one of the nights where they said there was $500.00 missing. I was sure I was going to be able to prove that they were wrong but as I counted I realized they weren't. I had no answers. I still have no answers!!!! I got let go. I have made several attempts to find out the status of the investigation as I was also told that the company was going to be investigating the relationship between me and my assistant outside of work. I am really going crazy wondering and worrying about this. I can't sleep and I am having nightmares! I am not guilty of anything except not noticing that he was doing it. I need help before I go crazy! I don't want to lose a roof over my head among many other things. Please email me with anything I need to know. Thanks so much!

They don't have to prove you did anything, in order to fire you.

They don't actually need a reason at all.

Outside of that if you get charged with theft or anything else you'll need to speak to a defense attorney asap.

All I want is for me to be able to move on with my life and be told that I am not suspected of anything. I am not wanting to go back to work there although I loved my job. I can't deal with the thought that I am being considered as one who would do this. Can they not be required to tell me something as I asked to speak to the investigator. I want this guy in jail and why wouldnt they be asking me questions instead of me sitting here not being able to sleep and having this consume my every thought every day.

I know you're worried, but there's really nothing you can do to force them to even acknowledge you at this point.

Is it unfair? It could very well be.

But is it legal? Perfectly so.

I'm sorry, because I know you're agonizing about it.

I am and I appreciate the caring. I have never been fired from any job. I was worried I was going to lose my job because sales were down. Now I know why because he was stealing the money but it wasn't me. I also do not care for people who milk any system if you know what I mean. I just feel that what I am going through is not warranted. Can't I not get a lawyer to get involved in the investigation? Or ????

There's nothing an attorney can do for you at this point. There are no laws that an attorney can invoke to force your former employer to either stop investigating you or to apprise you of the investigation's findings. Your former employer can ignore you completely, and this would be perfectly legal.

As you've been advised, you need to try very hard to get over this. Keeping busy by filing for UI and searching for a new job will help immensely.

There's another way of looking at it that might be easier for you to swallow.

Your assistant is believed to have stolen the money. As manager, you are responsible for the actions of your subordinates. If you had been paying sufficient care to your assistant's actions, he would not have been able to steal. You failed in your capacity as manager, which is a termination offense.

This perceptions allows for the termination, unfair as it may be. It allows for your being told that your boss does not believe you stole. But it does not put the mantle of "thief" on your shoulders.
