Urgent help is needed. I'm in FL. I have been on FMLA for 12 weeks. Prior to my return date, my former employer separated me due to documents unfiled and an issue she claims cost the company over $10,000. I'm unaware of what they're claiming that could have cost the company that amount. I have not received any warnings. Prior to me leaving we were on great standing. I had praise for upper level management and positive reviews. They have offered me a severance along with a bonus owed while I was on leave. I just want to know if the employer has cause was it ok for them to do so? Thank you for your helpful advise.

Contrary to popular belief, you CAN be let go while on FMLA if (basically) you would have been let go even if you weren't on FMLA. If they discovered an error that you made that was so egregious that you would have been terminated on the spot, then you can be terminated. The problem crops up if you are being terminated because you are on FMLA>

And if you have been on FMLA for 12 weeks, you're out of protected time anyway.

WHat was the nature of your supposed mistakes/blunders...were these things you supposedly bungled while active and before leave. OR problems that later arose because you were out and nobody picked up the ball in your absence ...?
