I am a resident of MA and I owe a debt under 1,300 but I'm being asked to sign a settlement for judgment in my district court via lustig glasser& wilson pc. My question is: is there any way a lawyer could help to rescind any court involvement to none and I could somehow pay this debt monthly, like I would have through the collection company? In dealing with midland, things were said by them that my two days late payment was not acceptable, over and over. Then after a few months they tried for a payment at a bad time and then lustig papers came. Could a lawyer undo these proceedings, or do I just have no choice since midland forwarded this to a lawyer? Thanks in advance.

They've (the original creditor) already tried payments and you didn't live up to your end of the bargain. If you *don't* sign, then they'll take it to court and get a judgment (for which you'll be responsible for the additional costs.)

I hardly see their efforts as any kind of bargaining to help me. I tried for a few months and it was only going to be two days late. I had no exceptions at all. They are as honorable as the lawyers they chose that Healey has been suing. This is not an old debt. I'll never use any credit again. Ty

YOU borrowed money from someone and didn't pay it back per the terms YOU agreed to, and now you're upset that they won't set up a payment plan? :rolleyes:

I bet that, if you would have sent the payment in, they would have cashed the check, even if it was two days late...

One other thing, they hv sent court papers for me to sign w $50 fee. So I guess,?it will be a court judgment on my credit either way? and itmentions nothing about interest. Ns if the amount is solid, or accruing in a zombie place.

Yes, I see that now and will advise anyone I know based on my experience. I am an honest person. I trusted what they said the same, over and over because they were in charge. I wouldn't think to act in an unruly way. It never crossed my mind.But clearly that's how they think of poor little me. Who lost her Fortune 500 job, always paid taxes and took out college loans to a degree that's become obsolete. Thx for your legal advising. M

It was your thought that they might have accepted a check anyway. If I did that when they continually told me No it wasn't ok, I think I'd be acting unruly. But it is the dept of injustice now..

Injustice?! YOU didn't uphold your side of the agreement. You're not really suggesting that they should suffer because you, like everyone on the planet at some point or another, was having a hard time? No, you can't be suggesting that.
