Two years ago I was charged with Identity theft and at the time of arrest they found 1/2 tablet Xanax in my purse.. my prescription had expired so I was also charged with possession.
I received "adjudication withheld" on the drug charge, but "guilty" on the Identity Theft. Sentence was one year probation, which I completed.. all fines paid and terminated early (6mos).
I understand that a guilty adjudication can not be expunged or sealed at all... I guess I can still have the drug charge sealed?
Other question is regarding possible clemency application... Am I understanding correctly that 10 years have to pass before I would even be elgible to file an application?
Does anyone know the number of approved clemency apps in Florida? I've searched, but can't seem to find any information.
Suffice it to say... as everyone says... I made one stupid mistake in my life. I lead a good life, am well educated, but got into a monetary situation that I couldn't see a way out of at the time. No credit was ever issued in the other individuals name, just an application that was denied. Yes, it's something I should have never applied for, and I regret it every day of my life.
But.. I would like to move on with my life... further my education and have a role in society.
If clemency is available, I'd at least like to take a shot at it. I have absolutely no other legal issues in my life, only 2 speeding tickets from years ago that were resolved, no points.
