A friend of mine that lives in Florida recently was charged with domestic violence, but has not been found guilty. His fiance' took their 5 month old child when this occured and has since refused visitation to the father. The father has even agreed to visit under supervision at a neutral location with the baby's Grandmother (Her Bio-Grandmother). She still refuses stating that she is afraid that the child will be kidnapped. My friend has spoken with a few law enforcement officers, all of which said that since there was no marraige the father has no legal visitation rights. Could this actually be true?? If so, if something were to happen to the mother, or the mother was found to be unfit...Who would gain custody of the child? How can this man caught in this terrible twist see his child?

My response:

It's true. Since there is no marriage, and paternity hasn't been proven, he has as much right to see and be with "his" child as much as I do - - and that's none.

Until he smartens up and takes her to court for a paternity test on himself and the child, he'll have no rights.

If the child is determined to be his, he'll be ordered to pay child support (assuming she is the one granted custody), and he'll finally obtain his visitation rights.

Now, if you're his friend, help him get her into court.
