What is the name of your state? Indiana, I have a coworker who has been useing fmla for her mother who has cancer she has also been on several short term med leaves for herself HR has informed her that they have combined her leaves and fmla and she is no longer eligable the rest of the year for any fmla. can the short term leaves be added into her fmla legally? I know she has abused it but now that she will really need it is not there.

She is entitled to a total of 12 weeks per 12 month period, and that's all. She does not get 12 weeks for care for her mother and another 12 weeks for herself.

If all the time she has taken qualifies under FMLA and she has used up her 12 weeks, then that's all she gets no matter how badly she might need more.
