In response to your two questions.

1.) No one can tell you how much time he will serve for his aggravated battery. Rough sentencing listed below.

§34. Aggravated battery

Aggravated battery is a battery committed with a dangerous weapon.

Whoever commits an aggravated battery shall be fined not more than five thousand dollars, imprisoned with or without hard labor for not more than ten years, or both.

Acts 1978, No. 394, §1. Amended by Acts 1980, No. 708, §1

2.) You can submit a victim impact statement to the District Attorney or speak at his sentencing (upon conviction) to tell the judge what you want and that you desire mental health treatment as part of his sentence. The judge may consider but is not bound by your request.

One person that responded to one of your original posts however is a mental health professional. She stated the chances of success are very low. Please read her response on the likelihood of mental health treatment being effective. Mental health issues exacerbate abuse but do not cause abuse. There are abusive people with no mental illness and mentally ill abusive people. The fact he is mentally ill (if he even is) makes him more dangerous. I really understand your desire and belief you can help him. You CAN'T though.

Please keep in mind that given his history it will be nothing short of a miracle if he changes. If you believe in miracles and give him that chance, the odds of you losing your children to the state of Louisiana are incredibly high. That would actually not be the worst case scenario however; death for you or your children is the worst case scenario.

Everyone that posted wants you to be safe. Please get in touch with your local domestic violence outreach center to join a support group or talk to someone about the dynamics of domestic violence and help you deal with the trauma being attacked, losing the person you thought would help you raise your child (together), losing your dream of a normal relationship, and focusing on you and your child's future.

I really do appreciate your reponse. I just wanted to help him, I am not bitter about his abuse towards me because if I allow myself to be affected by his actions again, I will start to hate him all over again and believe it or not my hatred towards him made me even more miserable in the past. However, I do really want him to spend time in jail in addition to getting some help because he has gotten away with this too long and too often.

I was already making plans to leave and he actually he found out the day that the altercation occurred which I believe triggered the event. But now I am really making plans to move out of our home within a month incase his family bails him out and he comes here again.

I am just unable to move faster than that because I am due to give birth on monday, so I am doing the best that I can right now by cleaning out my home so my move could be easier now that I won't have his help. Again, Thanks.

Given that situation, I would suggest that you go ahead and ask the judge to order mental health treatment.

HOWEVER, I would also ask the judge for a permanent restraining order forbidding him from EVER contacting you or your kids.
