My exhusband quitclaimed the house to me after our divorce. The mortgage was only in his name. He refused to give me the payment information and I had to take him back to court twice to get the "correct" payment information. In that time, the mortgage (which unknown to me was already behind) went into foreclosure. The morgage company wouldn't work with me because my name wasn't on the mortgage. (Exhusband went so far as to put "password" on the account so they wouldn't accidently talk to me) In the meantime, my ex (who makes $120,000 a year, compared to my $22,000) declared bankruptcy, including the mortgage and any money he owed to anyone per the divorce. (ME!) I went to the foreclosure proceeding, and the judge ordered the mortgate company to work with me and ordered a foreclosure date of 11/15/04. I began working with the mortgage company and then my exhusband took off to whereabouts unknown. Without his support payments there is no way on my salary I can take over these mortgage payments, or refinance it.
My daughter and I have lived in this house for 4 years, and I don't know where we're going to go, when this foreclosure happens. I have gone to the state and my exhusband is in "locate status" but have received no other information or help from them... According to social services, I can't get any help form them because to support two people in CT I can't make over $16,000 to get any state help.
Does anyone know, are there any laws to protect me while I'm trying to find him? Is there any help to find him? Late July the police came to my house looking for him because he tried to hire someone to hurt me and his current wife, he continues to use my address as his current address with everyone, so any attempt to find him brings me back to my own address! They have his social security number "tagged" but he'll find away to use someone elses or get paid under the table.
I can't afford to hire an attorney, and apparently with the small salary I make, I can't get any state help. Are there any other ways to help my daughter and I stay in our house?
