I purchased a house 20 months ago as an investment. I have 2 loans on this house through the same mortgage co.. In 5/04 I received a letter that my home was 2 payments behind. I called the co. and we found that all the money I had sent them was deposited into one account (even though different loan #'s were on the checks). The problem was corrected.
In 11/04 I received another phone call with the same problem. I explained to the lady that I had made my payments and explaind the problem that had occurred earlier in the year. I offered to send proof of payment, but the woman stated she would have to "look into it". On 11/15/04 I received foreclosure papers.
Today is 1/19/05 and I have sent all necessary documents to show payments sent for every month. I have lost the tenants at my house related to harassment by investors trying to buy the house before the foreclosure was processed ($2200.00 out of pocket). In fear of losing my house, I sold it.
My question is: Do I have grounds for a lawsuit if early payoff penalties are not waivered? Thanks.
