undefinedWhat is the name of your state? My state is NC. My daughter's Chapter 13 was dismissed and now the mortgage company is filing a foreclosure on her property and will not discuss letting her make payments because they say she is $10,000 in arrears on her payments which have been in bankruptcy. How can you be behind on payments if the bankruptcy trustee has been making payments? Email me at steele247@aol.com or just answer the thread.

Might be thinking the mortgage was in arrears when the bankruptcy was filed, and the arrearage was not caught back up yet. If so, then when she dismissed the bankruptcy, she became delinquent on the mortgage by dismissing the bankruptcy.

Yep, there are lots of possible scenarios that could support the mortgagor position.... and until the writer answers "And what EXACTLY did the bank say when she asked them that??", anything is a guess at best.
