What is the name of your state? Ohio Question--If a spouse has a foreign judgement against him and owns a rental property in his name only which is now for sale, what would happen if the property would sell---Could the wife, even tho the property is in husbands name only, claim part of sale proceeds because of any entitlement because of marriage? This is the only property in husbands name---Judgement is for 25K on a 6K bill--Have been trying to settle prior to any closing on property but have not received any response from other party--Any ideas Ladynred?

Oh man.. that's over my head, sorry. My initial thought though is that there would be no marital 'entitlement' to the proceeds of the sale - its not a community property state :(

**The judgment would need to be satisfied before title could transfer to the new owner**

Sioux - would that only apply though if there was a lien on the property ??

Yes and I am assuming that it will show up as a lien against the property once a title search is performed.
