I am in Illinois. I received a box of Russell Stover candies for Christmas (still wrapped in original cellophane). I was going out of town so gave the box to my sister to have. She stopped by today and brought the box over with a chewed piece of candy with a 1/2" nail (strange looking nail)in it. She was not physically injured as she was sucking on the caramel at the time...and said she thought it was a loose tooth of hers...when she saw what it was she became very distraught. I have notified the company today by letter and am wondering if we would have any legal recourse even though she was not physically injured.

I hope you kept the evidence. But the problem here is this: no injuries and you didn't pay for the candy. Check out products liability under personal injury at the freeadvice.com homepage. Go from there. Maybe you might be able to get free candy for a year! : - )
