I was arrested and had cash taken during my arrest and listed as a forfeiture. I I was arrested and had cash taken during my arrest and listed as a forfeiture. I was presented a plea agreement in which I was told I would receive this cash back. It is now been two months and I’m continuing to get a run around regarding this money presented a plea agreement in which I was told I would receive this cash back. It is now been two months and I’m continuing to get a run around regarding this Money. Is there a timeframe that exists on something like this? Or do I just have to sit and wait for them to find it convenient?

The civil asset forfeiture laws in North Dakota (and in some other states) are problematic. Even if found not guilty of a crime, it can be difficult or impossible for an accused to get seized property returned.

North Dakota has tried amending the laws but proposed legislation has failed to make it out of committee.

If the amount of money seized is substantial, you might want to seek out assistance from an attorney in your area. You could try finding help through the ACLU.

Good luck.
