can a former employee request their personal payroll records from a former employer?

Sure, you can ask. Nothing in the law prohibits you from asking the question.

However, nothing in either Federal or Oklahoma law requires the employer to show you the records. It's up to them if they want to comply or not.

Can they request the records? Sure. Is the employer legally obligated to comply? According to my source, Oklahoma law states that "unless the records are made confidentialy by law, an employee of a public body has the right to access his/her own personnel files."

(a) that's access - as in view - and (b) payroll records usually aren't part of an employee's personnel file. Wage history is in the employee's file but that's a different matter than actual payroll records.

Clarification:

Please note that Beth's response is for someone who is employed by a "public body". I could find NOTHING in any of my sources or on the Oklahoma web site to indicate that even a current employee, let alone a former employee, of a PRIVATE employer in Oklahoma, was entitled to see anything in their records with the exception of the results of any required medical examination. And, as Beth correctly points out, payroll records are generally not part of your employment file in any case.

I stand by my response.
