I forgot to put that Im in California.

I Had an empty beer bottle in my car, I was unaware. Probably from a couple of days before. When I was stopped, they saw the bottle, and wrote me an open container ticket.

Went to court, and cop on stand verified that I had no alcohol on my breath and needed no breathalizer or sobriety test. He even told judge that I had stated the bottle had been there for awhile. He testified the bottle was warm. The judge then said he didnt know how to rule, and I would be notified by mail in 2 weeks after he read up more. He could not make a ruling that day.

When I got the results, he ruled I was guilty. If they found me quilty, then anyone who recycles , if they have any alcohol cans or bottles, then they would be commiting numerous offenses!!!

Can I appeal? The judge is sooooo unfair! Noone ever wins in this court.

Please help me!

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Why not? I say appeal. See if IAAL's how to plead a ticket in california has anything in there about appealing. Also, under state statutes at the freeadvice.com homepage, look under traffic law and tickets. Do keyword searches.

Hope this helps. Fight the power!
