I signed for a property in NY for someone.
I'll assume for the sake of discussion that you co-signed the loan but did not become a co-owner on the deed. Understand that a co-signer is a guarantor of the loan and has only the obligation to pay or suffer the consequences of not paying.
The property is in foreclosure. I tried to evict them in order to do s short sale She filed something in the court and I am having hell moving forward.
As a co-signer (and not an owner) you have no power to evict. What she probably filed was a motion to dismiss because of that and it was probably granted.
She also got s modification without my permission .
She didn't need your permission.
I filed a police report but have not pressed chargers.
No crime has been committed so I suggest you not follow up on that lest you get prosecuted for filing a false police report or sued for defamation.
Not gonna happen. Co-signing is forever.
I also want to press charges against the financial institution for giving her the modification.
Also not gonna happen.
Common lament of co-signers when the borrower goes belly up financially.
Nothing.
You'll just have to ride it out and chalk it up to a life lesson from the school of hard knocks.
Co-signing is the kiss of death. Co-signers learn that every day. I expect that, somewhere, there is a support group for co-signers where they can meet once a week and tell their stories.
