A friend of mine was charged with DUI after he was found about 10 miles from a house he was at that night. He had been knocked unconscious (not by a car wreck but what the dr. thinks was a tire iron)and he had been thrown in the back of his truck. His blood was found in the cab but nothing was found inside the truck. The one trooper did not do a BAC on him b/c he was very delirious.He required 10 staples in his head from the injuries. The guy he was with at the house said he was "acting weird" and he hit my friend with a bar stool (which caused the injury). He then said my friend drove himself approx. 10 miles away onto the highway exit he was discovered on. My friend does not remember a thing! No tests were run at the hospital for possible BAC or any possible drugs (such as ecstacy,etc.). The front end of the truck was smashed in and it is now destroyed. My friend thinks that this guy hit him with something (this guy told a friend of his that it was a revolver he hit him with - he can't make up his mind!)and threw him in the back of the truck and drove him down the mountain -thinking he had possibly killed him.How can he be charged with DUI when there was no tests and it is evident he was too incapicitated to have driven himself after a hit like that? I am waaaay confused!
