What is the name of your state? Ohio
If you use a Lawyer on a case and you dismiss the case before it goes to court but after all diclossures are done(Divorce case) and the Lawyer says you still owe him money and you can prove that you do, Can that same lawyer represent our son against us? The Bar Assc here seems to think that there is no conflict of interest here. I know there are no ethics here on this so called attorney's part. And if we win our countersuit for Intentional Infliction of Emotional Stress agaisnt our son can we also sue the lawyer for the same for representing our son against us?
This whole case is based on $1000.00 for a wrecked car our son bought and left here. We asked him to remove it and he totally ignored our request and us after he turned 18 and moved out on his own. So we gave the car parts to a junk yard. Very complicated situation
Please don't judge me for this because you don't know the whole story.I would just like your opinion on my Conflict question.

There's an interesting story here.

Anyway, just based solely on the statements in your post, I would have to agree with you that the lawyer has a conflict of interest. Even if I am right, there is nothing you can sue the first lawyer for UNLESS he uses some info he got while representing you for divorce.

Why would the Bar Assc here feel there is no Conflict? Isn't him knowing that I have Bi-Polar and representing my son agaisnt me enough? And if I stll owe him money would'nt that mean he is stll MY LAWYER?

It seems to me that there is a conflict. The people who give the opinions at the Bar are not infallible. You (or your attorney) can file a motion in your current case to disqualify him because he has a conflict of interest, and state the reason. Without knowing how much harm he has caused you, it is hard to say whether you can or should sue him.

Harm, Reason for Conflict of Interest

This case has caused me to be put back on some of my Meds I was able to be off of for about 6mos. It has litterally consumed me, let alone my husband.and our 12yr old daughter. I filed a complaint and they said "since I didn't tell him any secreats they don't feel there is conflict of Interest in this case. I can fax you the letter if you would like! And they also said maybe I should pay my bill. This whole situation really started over a cell phone bill, my sons girlfriends mother(Sue) decided she was going to port out T.J's cell phone number we gave him 2yrs prior to him turning 18, to her Nextell acct. This number was on our business acct at Verizon, I recieved a notice from Verizon saying we owed them $518.00 for early termination of the number I called to find out what was going on and they told me about the number being ported to a Nextell Acct. so i Called Nextell and followed the prompts and got some information on how and when it was ported out. Well (GFM) Sue decided she was going to press charges on ME for getting the information.Claims I broke The Patriot Act against her. They sent a dectective to my home and he did exactly what I did on the phone and got the same info I did, These would of been FEDERAL charges to. He went and told them I did nothing wrong but if I wanted to I had a Civil case agaist them Sue and T.J. for them doing what they did with my business #. I just let it go! Then these car part come up and she e-mails me and says I owe HER $1000.00 for the parts because she lent T.J. the money to get the wrecked car. And Then I get a summons to go to court because MY SON is suing ME for $4500.00.I have all this documented. And the story goes on and on.
