question for a friend....under the Illinois definition of "third party caregiver" (which I cannot find) is father's live in girlfriend considered a third party caregiver?
their order states
"Both parties shall have the right of first refusal to be with the minor children for any time period that the other party will be traveling out of town away from the children or if the parent is unavailable to care for the children for more than three hours. Rather than send the children to a daycare provider, grandparent or other third party caregiver, the other parent shall have the right to have the children in their care. As a result, each party shall notify the other party in advance if they will be personally unable to care for the children because they are out of town or if they will need a babysitter for more than three hours. The other parent would then have the right to have the children in their care for that specific time period that the other parent is gone. This does not interfere with grandparent time or other times when the parent is available but chooses to let the children stay with a grandparent or go to a friend's house, etc."
dad expects to invoke FROR if mom intends to leave the children with her husband yet then states his girlfriend is not a 3rd party caregiver....
