Frustrated with dishonest doctor

My husband went to a chiropracter and asked the doctor before getting any services whether he was in-ntework. he gave the doctor our insurance card and asked whether the doctor accepted our insurance. the doctor said he will check and that meanwhile my husband will only be responsible for co-pay of $25. My husband insisted on finding out first but the doctor kept saying it was OK and the only thing it will cost us is a co-pay. Then he took the X-Rays and later we got a bill of $400 because that's how much our out-of-network deductible is.

I understand that it was my husbands responsibility to find out whether the doctor was in-network or out of network but he didn't.

Even though my husband got screwed on his own fault, nevertheless the doctor did lie to him so we decided not to proceed with that doctor because we do not trust him. So we called and asked him to give us the X-Rays so we could go to another doctor who was in-network and we didn't want to pay again for X-Rays.

We asked if we could make payments and doctor said OK but that he will not give us any receipts and we will only get X-Rays after the full balance is paid. He insists on us coming into the office to pay and that he will write down how much we paid on a piece of paper in his office untill the total is paid. Only then we will get the receipt and X-Rays. We do not believe him because he already lied before. And also we cannot come in every time we make payments and wanted to mail them and the doctor refused to mail us back the receipt for each payment. He gets very irritated and says that it's too much for his staff and it's unnecessary extra work.

My question is if there is anything I can do to ensure that he will give us the X-Rays after we are done paying and if there is anything we can do if he later claims we didn't pay him (even if we have a copy of every check he cashed).

What are our options?

How do you propose to prove that the doctor knowingly lied as opposed to innocently making an error?

I interpret the underlined as the Chiropractor agree that, until it could be determined whether he was in network, your husband was responsible for the $25 co-pay. Once the determination of his OON status was made, your husband was responsible for the OON amount.

Yes, it was. Ultimately it is the policy holder's responsibility to confirm network/contract status with your insurance company BEFORE receiving treatment. Lesson learned.

He didn't actually lie. He said he'd check his network status. Now, do I personally think he was full of it? Sure do. However, your husband did receive services and is responsible to pay for them. He can try to negotiate with the Chiro to pay the amount your insurance company would have paid if he were a contracted provider. The x-rays (and any other records) are the property of the Chiro. You are entitled to copies of them, and there may be a nominal fee charged to obtain those copies.

This guy sounds like a real jerk. Unfortunately, it's not illegal to be a jerk. In most states he cannot withhold your records because you did not pay your bill. Your records may be withheld only if you refuse to pay the fee incurred for copying them.

My question is if there is anything I can do to ensure that he will give us the X-Rays after we are done paying and if there is anything we can do if he later claims we didn't pay him (even if we have a copy of every check he cashed).

Pay him by check so there is a record of your payment. Then check your state law regarding record releases. You may also try to contact his licensing board to file a complaint.

I do not propose to prove anything. I am simply asking for an advice on how can I ensure (if it is at all possible) that we get those X-Rays after we pay off the balance. And another question is if we are entitled to a receipt every time we make a payment. That's all

That's actually my question, what can I do, after we paid off balance (of course by check, especially since to receipt will be provided) in order to recieve copies of X-Rays?
i seriously suspect that being a jerk he will try to give us a hard time about releasing X-Rays, so i wanted us to be prepared in advance to take some action to get our X-Rays

I would go to your new doctor and have your new doctor request the x-rays.

In most states, doctors can not hold a patient's records hostage, and must release them, pending only what is deemed the reasonable cost of duplicating them.

It is common practice that mostly practitioners going to give mental& physical harm their patient rather than peas & tranquility. It can only be stop by strict legislation & its implementation..:D
