i live in pennsylvania and am in the middle of two legal cases, a divorce and a personal injury due to an auto accident. my soon to be ex is taking me to court to place a restraining order on the distribution of funds from the personal injury suit. he is also suing for consortum (spelling?)do to my personal injuries. we were still together when i filed the personal injury suit, six months after the filing we separated. he claims that whatever funds i receive should be considered marital property. the paper work i received that was filed with the court to have a restraining order placed on the disbursement has false information on them and they were verified and signed by the ex. i have two questions. when the personal injury case settles will the monies be considered marital property because the accident occurred 11 months before we separated? also, can his signing papers with false information be considered perjury?
fyi, the papers indicate that he was in the accident and suffered personal injury. i was the only one in the vehicle and i am the only one who suffered personal injuries. thanking you in advance for your time and assistance. i tried to make this a brief as possible,
