Generally, games are not patentable subject matter, because they are not an "invention." Here's what's patentable, 35 U.S.C. 101:
"Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title."
Games, as a whole, do not meet the requirements for being patentable subject matter.
Look to copyright and/or trademark as the avenue for protecting your game.
