What is the name of your state (only U.S. law)? new york

We are a gay couple, our situation is that we would like to get married in New York City. The problem is that I am in NY and my girlfriend is in Egypt, she is a Muslim. If she comes to America and we get married. I don't want her to go back to Egypt, it's possible that she could be in danger. Can we apply for asylum? Will Immigration services be able to assist us in this matter. If so.. how and what steps should we take to do so. As it stands a gay couple doesnt have the same legal rights as a straight couple. So Im concerned if this is even possible since we are a gay couple? Thank You for your help. :cool:

USCIS does not recognize same-sex marriage for immigration purposes.

There's nothing to prevent your girlfriend from coming here to the U.S., but she won't be granted a K-1 fiancé visa for it, as USCIS does not currently recognize same-sex marriages. And if she applies for a different visa and ends up getting married here with a plan to stay, then USCIS may end up denying any petition for permanent residency based upon lying about the REAL reason she came here.

Real world examples:

1:

Mr Brit is visiting the US. Meets Ms US while here. Ends up getting married. The application for residency would generally be approved.

2:

Mr Brit meets Ms US in London. He proposes, she accepts. She flies home. Then he then enters the US on the VWP knowing that he's getting married with the intent to live in the US. The application for residency would likely be denied.
